The ABIC contracts have now been launched, representing the most contemporary version of the most widely used building contract in Australia. The release is the result of a comprehensive review and provides the market with an up-to-the-minute suite of standard form contracts for a variety of building works.
ABIC contracts are intended for use in building projects where an architect administers the contract. They are designed to make contract administration clear and less prone to dispute or time-consuming negotiation. ABIC contracts bring certainty to the process. They have been extensively refined and field-tested, and feature: plain English and a clear, logical structure that reflects the sequence of the construction process equitable allocation of virtually all project risks to one party or the other, eliminating uncertainty and many potential disputes an integrated suite of versions for major, simple and basic works, and for housing and non-housing projects detailed supporting documents, including a user guide, template forms for the architect and the contractor Selecting the right contract There are different contracts for each state and territory and for various types of projects.

ABIC MW H Major Works — Housing Major Works Housing contracts are state and territory specific contracts for housing work, with appropriate conditions integrated into the contract to comply with state or territory housing legislation.

The SW contract should be selected to suit each individual project, taking account of its complexity, value and any specific project issues or requirements. Compared to the MW contract, the SW does not provide contract mechanisms for: --urgent instructions --separable parts to the works staged practical completion --change of type of security --security from owner to contractor --dangerous or contaminated materials --encroachments --quality assurance systems --separate contractors.
ABIC SW H Simple Works — Housing Simple Works Housing contracts are state and territory specific contracts for housing work, with appropriate conditions integrated into the contract to address legal requirements of state and territory housing legislation.
It is a short-form contract where almost all detail and contract information is known and specified at tender and the commencement of the work. This contract is not suitable for use on domestic, housing, residential or home building work, where the project is subject to the relevant legislation in that state of territory.
Costs plus is a contract form suited to circumstances where there is insufficient detail at the commencement of work for a final cost to be calculated. Depending on the option selected in the CP C, the fee is either a fixed fee or a percentage of the cost of the works.
When purchased for use in Queensland, unique special conditions for commercial and industrial projects are included with the contract. EW-1 is also suitable for housing projects using the relevant special conditions included in the pack for the relevant state or territory, other than Queensland.
